W. Stuart Home, III
W. Stuart Home, III has specialized in construction defect litigation for over 30 years representing contractors and subcontractors in complex construction defect litigation. His extensive experience in insurance defense for construction defect litigation provides him with an in-depth knowledge of insurance companies, insurance claim handling and the efficient handling of complex litigation. He joined Clapp Moroney in 2022 as a Senior Trial Attorney.
Stuart graduated from U.C. Riverside with a B.A. in political science and then attended law school at McGeorge School of Law. He comes from a tradition of law in his family, as both his father and grandfather were attorneys. In 1991, upon graduating from law school, he went to work at a general practice firm of three attorneys. It was during this time that Stuart began discovering his passion for construction defect litigation. In 1998, he went to work for a state-wide defense firm and gained experience representing developers, general contractors and subcontractors.
Stuart has always enjoyed the courtroom and trial work. During his tenure at a Sacramento firm in 2001, he tried two jury trials to completion on his own. In 2018, while working as staff counsel at AIG, he was first chair in a month-long jury trial in Contra Costa County that obtained a defense verdict. The case involved defending a window manufacturer and installer against a multi-million dollar defect claim brought by a condominium association. Over his career he has been involved in numerous bench and jury trials and is an experienced litigator.
Throughout his career Stuart has handled a variety of cases in other areas of the law. He has extensive experience defending bodily injury claims as well as product liability defense and business litigation. His practice has also included representing public agencies, handling California Environmental Quality Act (CEQA) cases and real estate law.
Stuart's extensive experience and skill with computers and their application to the practice of law has always helped facilitate his career. In the late 1990's he chaired the technology section of the Sacramento County Bar Association. He has applied his computer skills to trial work and in the efficient handling of the massive amounts of electronic data generated in construction defect litigation.
Stuart has been actively involved during his career with a number of professional organizations. In 2005, he served as the President of the Sacramento County Bar Association, culminating 7 years of dedicated service to that organization. He also chaired the technology section of that organization, as well as the Conference of Delegates, a quasi-legislative body previously associated with the State Bar. He is currently a member of the Association of Defense Counsel of Northern California and Nevada and a member of the Contra Costa County Bar Association.
In addition to these professional organizations, Stuart is also actively involved in Breakthrough for Men, a Monterey County non-profit organization that provides workshops for men in communication, parenting skills and how to lead more productive and fulfilling lives.
In his leisure time, Stuart is an avid skier and enjoys cycling and swimming. He is the father of four grown children and lives in Moraga, California.
